Acceptance of Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("User", "Owner", "Tenant", or "Visitor") and Orbit Realty Private Limited ("Orbit Housing", "we", "us", "our"), the operator of orbithousing.in and related services.
By accessing our website, submitting a listing, making an enquiry, using the Owner Dashboard, or engaging with Orbit Housing staff on any matter related to our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, you must immediately stop using our platform and services.

You must be at least 18 years of age to use our services, list a property, or enter into any transaction facilitated by Orbit Housing. By using this platform, you confirm you are 18 or older.

Description of Services
Orbit Housing is a real estate intermediary and matching platform operating in Davanagere and expanding Karnataka districts. We are not a passive property portal. Our services include:
Property listing and verification — We accept listing submissions from owners, conduct field verification, photograph properties, and publish verified listings on our platform
Tenant and buyer matching — We match tenant requirements with available listings using our matching engine and local knowledge
Site visit coordination — Our team coordinates property visits between interested parties and property owners
Short stay listings — We list service apartments, aparthotels, coliving spaces, guest houses, homestays, B&Bs, PGs, extended stay units, and transit stays
Owner Dashboard — Owners can log in with phone OTP to view and update their listing status
ℹ️ We Are an Intermediary, Not a Party to Rental Agreements
Orbit Housing facilitates the connection between owners and tenants. The actual rental/sale agreement is entered into between the owner and tenant/buyer directly. Orbit Housing is not a party to that agreement and bears no liability for disputes arising from it.

Brokerage Model & Service Fees
Our Brokerage Policy
Orbit Housing operates on a brokerage / service fee model. A service charge applies when a successful transaction is completed through our platform. This includes:
Rental agreement facilitated through Orbit Housing (long-term rent)
Short-stay booking confirmed through our enquiry system
Property sale where Orbit Housing introduced the buyer to the seller
Fee Disclosure
💰 Service Fee Commitment
The exact service fee will always be clearly disclosed to both owner and tenant/buyer before any agreement is signed or payment is made. We will never apply a service charge that was not agreed upon in advance. All listings show "Service charge applicable" as a permanent notice.
No "Zero Brokerage" Claims
Orbit Housing does not operate as a "zero brokerage" or "direct owner" portal. We are professional real estate intermediaries. Our service fee compensates for field verification, photography, matching, coordination, and ongoing support — services that a pure portal does not provide.
Anti-Bypass Clause
If Orbit Housing introduces a property owner and a tenant/buyer, and those parties proceed to enter an agreement without engaging Orbit Housing (i.e., bypassing our service fee), Orbit Housing reserves the right to claim the applicable service fee from both parties, as both parties were introduced to each other through our platform.

Property Owner — Listing Rules
By submitting a property for listing on Orbit Housing, the owner agrees to the following:
Accuracy — All details submitted (rent, size, amenities, availability, address) must be accurate and kept up to date. Deliberately false information may result in immediate delisting.
Ownership / Authority — You confirm that you are the owner or legally authorized agent of the property, and have the right to list and rent/sell it.
Exclusive Coordination — During the active listing period, enquiries routed by Orbit Housing should be processed through our coordination team, not independently, to ensure brokerage applies correctly.
Availability Updates — You must notify Orbit Housing within 48 hours if a property is rented, sold, or withdrawn from the market, to avoid misleading potential tenants.
Photos & Content — Property photos and content submitted to us may be used on our website, social media, and marketing materials during the active listing period. You grant Orbit Housing a non-exclusive, royalty-free licence to use this content for this purpose.
Compliance with Indian Law — The property must be eligible for rental/sale under applicable Karnataka and Indian laws. Rent must comply with the Karnataka Rent Control Act where applicable.
Non-Discrimination — While Indian law allows food preferences (veg/non-veg), gender preferences, and tenant-type filters, Orbit Housing listings must not discriminate on the basis of religion, caste, or ethnicity.

Tenant / Buyer — Platform Rules
Accurate Requirements — When submitting a tenant requirement, provide accurate information about your budget, preferred area, and type of accommodation. Providing false information to gain access to listings is prohibited.
Respectful Communication — During property visits and negotiations coordinated by Orbit Housing, treat property owners and Orbit staff with respect. Abusive or threatening behavior will result in your account being banned.
No Direct Solicitation Post-Introduction — Once Orbit Housing has introduced you to a property, do not negotiate or transact directly with the owner while bypassing our service fee.
Verification of Details — While we field-verify listings, tenants are responsible for conducting their own due diligence on the property before signing a rental or purchase agreement.
One Enquiry Per Property — Submitting multiple duplicate enquiries for the same property to circumvent our system is prohibited.

Listing Accuracy & Our Verification
Orbit Housing conducts field verification of listings before publication. However, we make no warranty that:
Listing details are 100% accurate at any given time after publication
A property will remain available until you view it
Photos accurately represent the current condition of the property
Price, terms, or availability have not changed since the last update

Prohibited Use
You agree not to use Orbit Housing's platform or services for any of the following:
Listing properties you do not own or are not authorized to list
Submitting fake enquiries to gather owner information
Scraping, crawling, or automated harvesting of listing data for commercial use
Circumventing our brokerage fee through direct post-introduction transactions
Posting fraudulent, misleading, or illegal property listings
Using our platform for money laundering or any illegal activity
Impersonating Orbit Housing staff, other users, or property owners
Reverse-engineering, decompiling, or attempting to access our backend systems
Using our platform to advertise competing real estate services
Violation of any of the above may result in immediate termination of your access, legal action, and a claim for damages.

Intellectual Property
All content on orbithousing.in — including but not limited to website design, code, text, logos, the "Orbit Housing" and "Orbit Realty" brand names, property descriptions written by our team, blog articles, data compilations, and matching algorithms — is the exclusive intellectual property of Orbit Realty Private Limited.
You may not reproduce, republish, distribute, or create derivative works from our content without our prior written permission, except for:
Personal, non-commercial use (e.g., saving a listing URL to share with family)
Brief quotation with attribution and a link back to our page
Our AI-generated content, matching engine outputs, and data compilations from verified listings are protected as a database right and trade secret. Unauthorized commercial use or copying will be pursued legally.

Liability Limitation & Disclaimers
⚠️ Important Limitation
Orbit Housing is an intermediary platform. To the maximum extent permitted by Indian law, our total liability to any user for any claim arising from use of our platform is limited to the service fee actually paid by that user to Orbit Housing in connection with the specific transaction giving rise to the claim.
We are not liable for:
Disputes between owners and tenants/buyers arising from a rental or sale agreement
Loss or damage to property during or after a site visit
Inaccuracies in listing data provided by property owners
Failure of a transaction to close for any reason
Actions of third parties (e.g., WhatsApp, Cloudflare, CallMeBot) providing services we rely on
Loss of profit, revenue, or business arising from reliance on our platform
Technical downtime, data loss, or service interruption

Termination of Access
Orbit Housing reserves the right to terminate or suspend your access to our platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or caused harm to other users, property owners, or our platform.
Owners may request delisting of their property at any time by contacting us. Delisting will not affect any brokerage obligations that arose prior to the delisting request.

Disputes & Governing Law
These Terms are governed by the laws of India, specifically including Karnataka state law where applicable. Any dispute arising from or related to these Terms or your use of Orbit Housing's services shall be subject to the exclusive jurisdiction of the courts at Davanagere, Karnataka, India.
Dispute Resolution Process
Direct Resolution — Contact us first at contact@orbithousing.in or +91 9590007244. Most issues are resolved within 5 working days.
Mediation — If not resolved, both parties agree to attempt mediation through a mutually agreed mediator before filing court proceedings.
Litigation — If mediation fails, disputes shall be filed in the appropriate civil court at Davanagere, Karnataka.
