Description of Services

Orbit Housing is a real estate technology and direct matching platform operating across India. Our services include:

• Owner Direct discovery — We provide a direct discovery portal connecting verified property owners with prospective tenants and buyers
• Digital listing review — We review owner submissions for photo originality, pricing consistency, valid contact numbers, and basic ownership documentation
• Orbit Managed properties — For select properties managed directly by Orbit with written owner authorization, we conduct physical on-site inspections
• Owner Dashboard — Owners can manage listings, confirm 30-day availability, and monitor tenant enquiries
• AI-assisted search — Natural language search with Indian-specific filters (Vastu, Food preferences, Facing direction)

Owner Direct & Free Launch Period Policy

100% Free During Public Launch

Orbit Housing operates on an Owner Direct · Free Launch model. During our public launch pilot (valid until 31 March 2027):

• Zero Listing Fees — Self-listing by verified property owners is completely free.
• Zero Brokerage Cuts — Orbit Housing does not deduct or demand brokerage commissions from tenants or self-listing owners.
• Direct WhatsApp Communication — Qualified tenant inquiries route directly to the property owner's WhatsApp desk. Rent and security deposits are transacted directly between owner and tenant.

Property Owner Rules & Strict Anti-Broker Enforcement

By submitting a property for listing on Orbit Housing, you agree to the following binding rules:

1. Strict Owner / Family Declaration — You must be the legal title holder or an authorized immediate family member of the property. Commercial brokers, agencies, sub-agents, and unauthorized intermediaries are strictly prohibited from listing.
2. Right to Remove Listings and Ban Phone Numbers — Orbit Housing actively monitors for duplicate phone numbers across multiple listings, stock/reused agency photos, and commercial agency wording ("our client", "multiple flats available"). Orbit Housing reserves the absolute, unilateral right to delete any listing determined to be posted by a broker or commercial agent without warning, and permanently ban the associated phone number and IP address from the platform.
3. Re-Review After Critical Edits — If an owner modifies the rent price, property photos, address, or contact number after initial approval, the listing will automatically revert to Pending Review status until re-screened by the Orbit review desk.
4. 30-Day Availability Confirmation — Owners must confirm listing availability every 30 days via the Owner Dashboard. Listings not confirmed within 30 days will be auto-hidden to keep platform inventory fresh and accurate.
5. Light Ownership Proof — Owners may be asked to provide light ownership verification (such as a recent electricity bill, municipal property tax receipt, or Khata copy). Documents are reviewed privately and deleted immediately post-review under our DPDP Act 2023 compliance protocol.
6. Non-Discrimination Policy — While Indian law allows reasonable owner preferences for diet (veg/non-veg) and tenancy structure (family/company lease), listings must strictly adhere to Indian law and never discriminate on grounds of caste, religion, or community.

Tenant / Buyer — Platform Rules

1. Accurate Requirements — Tenants must provide accurate contact and requirement details. Submitting deceptive inquiries or scraping owner numbers is strictly prohibited.
2. Report Suspected Brokers — If a lister attempts to charge unauthorized brokerage, claims to represent "a client", or demands advance token money before a physical visit, tenants are urged to tap the "Report as broker" button immediately.
3. Zero Advance Money Before Visiting — Never transfer token advance money or booking amounts prior to physically visiting the property and inspecting the premises in person. Orbit Housing will never request advance payments on behalf of owners.

Review vs. Verification & Limitations of Liability

To ensure total clarity for all users, Orbit Housing applies two distinct listing labels:

• Owner-listed · Reviewed by Orbit — Indicates that our digital review desk checked that the listing appears complete and genuine, photos are not stock images, and basic contact/utility documentation was supplied. Important Notice: Orbit's digital review checks that the listing looks genuine; it does NOT certify that all facts are true, nor does it certify physical structural condition, safety, or legal title authenticity. Tenants must perform their own physical inspection and lease verification prior to signing.
• Orbit Verified — Reserved exclusively for properties that Orbit actively manages during the launch period, where written owner authorization ("I authorise Orbit to list and manage my property") is on record and our team has physically visited and seen the property in person.

Orbit Housing disclaims all liability for latent defects, maintenance disputes, owner-tenant contract breaches, or misrepresentations made by either party.

Prohibited Use

You agree not to use Orbit Housing's platform or services for any of the following:

• Listing properties you do not own or are not authorized to list
• Submitting fake enquiries to gather owner information
• Scraping, crawling, or automated harvesting of listing data for commercial use
• Circumventing our brokerage fee through direct post-introduction transactions
• Posting fraudulent, misleading, or illegal property listings
• Using our platform for money laundering or any illegal activity
• Impersonating Orbit Housing staff, other users, or property owners
• Reverse-engineering, decompiling, or attempting to access our backend systems
• Using our platform to advertise competing real estate services

Violation of any of the above may result in immediate termination of your access, legal action, and a claim for damages.

Intellectual Property

All content on orbithousing.in — including but not limited to website design, code, text, logos, the "Orbit Housing" and "Orbit Realty" brand names, property descriptions written by our team, blog articles, data compilations, and matching algorithms — is the exclusive intellectual property of Orbit Reality Private Limited.

You may not reproduce, republish, distribute, or create derivative works from our content without our prior written permission, except for:

• Personal, non-commercial use (e.g., saving a listing URL to share with family)
• Brief quotation with attribution and a link back to our page

Our AI-generated content, matching engine outputs, and data compilations from verified listings are protected as a database right and trade secret. Unauthorized commercial use or copying will be pursued legally.

Liability Limitation & Disclaimers

We are not liable for:

• Disputes between owners and tenants/buyers arising from a rental or sale agreement
• Loss or damage to property during or after a site visit
• Inaccuracies in listing data provided by property owners
• Failure of a transaction to close for any reason
• Actions of third parties (e.g., WhatsApp, Cloudflare, CallMeBot) providing services we rely on
• Loss of profit, revenue, or business arising from reliance on our platform
• Technical downtime, data loss, or service interruption

Termination of Access

Orbit Housing reserves the right to terminate or suspend your access to our platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or caused harm to other users, property owners, or our platform.

Owners may request delisting of their property at any time by contacting us. Delisting will not affect any brokerage obligations that arose prior to the delisting request.

Disputes & Governing Law

These Terms are governed by the laws of India, specifically including Karnataka state law where applicable. Any dispute arising from or related to these Terms or your use of Orbit Housing's services shall be subject to the exclusive jurisdiction of the courts at Davanagere, Karnataka, India.

Dispute Resolution Process

1. Direct Resolution — Contact us first at contact@orbithousing.in or +91 86601 88232. Most issues are resolved within 5 working days.
2. Mediation — If not resolved, both parties agree to attempt mediation through a mutually agreed mediator before filing court proceedings.
3. Litigation — If mediation fails, disputes shall be filed in the appropriate civil court at Davanagere, Karnataka.
